Joanna Swatzel v John Dyche

I don't remember how I happened upon this case. Google may have magically included it in my ads because it knew I was looking for it. However I stumbled upon it, I'm glad I did because it ties together a couple of theories I had been piecing together about the origins of the Swatzel family in Greene County, Tennessee.


The case centers around an only child, Joanna Swatzel, whose father, Joseph Swatzel, and mother, Polly, both pass away before 1814, without leaving a will. No exact dates of their deaths are given. She is given by the courts to Christian Dyche to be her guardian.

At some point her paternal grandfather also dies intestate and, by law, leaves her Joseph's share of the inheritance. Long story short, about $120 due to Joanna is taken by Christian and used to pay other debts. Christian then dies about 1834 and leaves his son John as administrator to his estate. John says he knows nothing of this inheritance and refuses to pay Joanna, who, still under 21 years old has her new guardian sue John for payment.



No relationship between Joanna and Christian is provided. I have a copy of the original documents available here. I've transcribed the case documents below. I also found the probate records dated 27 September 1834 (recorded 27 Oct 1834) where John is appointed administrator of Christian's estate. He had paid bond on this in July of 1834 (lots of dates in this small record).



Analysis
While there is nothing ground breaking in the case itself, there are a few key genealogical findings that helped me further establish the connection of the Swatzel's in Greene County to Johann Henrich Schwartzel of Lancaster and Cumberland counties, Pennsylvania.

We know from previous research of Philip Swatzel's 1833 pension application that he was from Lancaster and Cumberland Counties, PA and that he lived in Maryland and Virginia prior to arriving in Greene County in 1800. We also know from research of Philip Swatzel that his son, John Swatzel lived in Greene County, moved to Augusta County, Virginia, and then back to Greene County.

In these court documents we find that Joseph's father died in Virginia sometime between 1814 and 1833. Further in the document it states specifically that he was from Staunton, Augusta County, Virginia. This connection proves that Philip, his wife and children, weren't the only Swatzel's to move to Greene County in the early 1800's.

Further research on Joanna shows that she married Daniel Williamson in 1834, had three children, and died in Independence County, Arkansas on 22 Jan 1883. Information from findagrave has her birth date as 10 September 1812.

Sorting through the Josephs
In the early to mid-1800's there are a few different Joseph Swatzel's. I believe there are at least three at various points in time. Here's a list of the records I have pertaining to any Joseph Swatzel in the Greater Greene County Area:

We know that Philip had a son named Joseph from his will in 1840. It's likely that he is the Joseph in the 1840 census. He may be associated with one or more of the War of 1812 records.

We know that John had a son named Joseph from his appearance in court in 1822. He's likely the Joseph in the 1830 and 1850 census and married Amelia Lafollet in 1826.

The Joseph who died in 1814 is Joanna's father. In the probate records his administrator is Polly Swatzel, the same Polly mentioned in Joanna's court records. I believe this also means that this Joseph married Polly Gibson in 1813.

Our brief research of Joanna shows she was born in 1812. Polly was likely pregnant before Joseph went off to war and they married when he came back and he may have enlisted again after their marriage. There isn't enough detail in the military records I found to make any decisive conclusions but this story could have played out. No cause of death is listed in the current documents.

Theories and Speculation
Based on other research of the Swatzel's of Augusta County the most likely candidate for Joseph's father is Johannes Schwartzel, also known as John A. Swortzel, who was Philip's older brother and son of Johann Henrich Schwartzel. John A. Swortzel died in 1815 and is buried just outside Staunton. He is the only one with a similar name to be buried in Augusta County in the time frame of Joanna's court case.

Until I complete a more thorough family record hunt in Augusta, VA I'm penciling in John A. Swortzel as the father of Joseph Swatzel.

Update: John Swortzell of Augusta County, VA left a will dated 24 December, 1813 that included a son, Joseph (last line). This likely confirms the relationship between these two.

years since Joseph Swatzel her father, departed this life in-
terstate in the County of Greene aforesaid leaving a wife and 
one child your Petitioner - you petitioner further shareth
that shortly there after the father of said Joseph and Granda-
ther of you Petitioner departed their life in the state of Vir-
ginia, possessed of considerable estate, to a Share of which your 
Petitioner was entitled by Law in representation of her deceased

cannot now recollect but is very confident Polly was the name 
of the mother. Administrator of said ward and believes the 
Childs name joanna. That Deponent received the papers & Congress who was going to Staunton ( the place where the claim was to be collected & had Arrangements for the payment of the money - that he returned home and met wirth said Dyche at Greeneveille who represented to him the pressing necessity he had for money alledging that he was owing Mr. William [Hickroux] money and urged Witness to advance the money to him, Where upon Witness called upon Mr. George Joner & barrowed from $100 having with him the Residue & paid Mr. Christian Dyche the amount of money which was due on the claim lodged by him at Staunton and then collected & funded the dame taken said Witness cannot now positively state the amount paid or received

He is under the impression Dyches receipt may necessary

enclosed to Mr. Carson of that place. In as much as he can-

Solicitor prays an Appeal in the nature of a writ to Error to
The most Supreme Court of Errors and Appeals to be held at 
Knoxville and having given Bond and Security for the prosecution 
of his Appeal the same is allowed and the proceedings ordered 
to be certified


The State of Tennessee to wit
Know all men by these present that [Ale] John Dyche
and Thomas D Arnold of the County of Greene and State of 
Tennessee are Heirs and held and firmly bound unto Joanna 
Swatzel who sued by James Roberts Guardian in the Sum of 
two hundred and fifty Dollars to which payment well and truly 
to be made we bind ourselves and heirs, executors, and administrators 
jointly and severally firmly by these presents Sealed with our 
seals and dated this 13th Day of September 1836
The Condition of the above obligation is such that 
whereas a suit has this day been determined in the Chancery 
Court held of Greensville wherein the said Joanna Swatzel by 
her Guardian was Complainant and the said John Dyche Admin
As Respondent from which Decree the said John Dyche has 
prayed and obtained an Appeal to the most Supreme Court 
of Errors and Appeals to be held at Knoxville. If therefore the 
Said John Dyche shale prosecute with office his said appeal 
or in case he fails therein that the said John Dyche will well 
and truly pay and satisfy such Judgement and Decree as the said 
Supreme Court of Errors and Appeals may make in said Cause
Together with all such costs and damages which shall be received 
against him by said Joanna Swatzel for wrongfully prosecuting 
said Appeal then this obligation to be void otherwise to be and re-
main in full force and virtue John Dyche by his
